Online Ordering Terms and Conditions

Who We Are
This online reload service (the “Service”) is provided by Ian Spight Pty Ltd trading as “The Currency Exchange” (ABN 78 096 644 094) referred to as “The Currency Exchange” or “we” or “us” or “our”. Our Registered Office is at: Shop N122, Wollongong Central, 200 Crown St, Wollongong NSW 2500 Australia. What These Terms Apply To
These terms and conditions apply to the Service – which consists of retail foreign currency transactions (Australian to foreign and foreign to Australian). 
 
Use of the Service
The Service is only available to individuals aged 18 years or over and who are resident in Australia. By ordering foreign currency from us via this site, you confirm that you have read and understood these terms and conditions and agree to be bound by them and to comply with all applicable laws and regulations. The Currency Exchange reserves the right to refuse this Service to any person found to be acting outside these terms and conditions. The Service is only available for the purchase or sale of physical foreign currency in the currencies listed on our website www.thecurrencyexchange.com.au .
 
Availability of the Service may be subject to further monetary limits, currency exchange restrictions and customers abiding by these terms and conditions. These limits are subject to change from time to time at The Currency Exchange’s sole discretion.
 
Placing a Currency Order
To place an order, follow the instructions on the website ordering pages. You are able to correct errors on your order up to the point at which you click on the “Complete Order” button on the “Order Summary” page. The exchange rates we quote are subject to change. We will use the exchange rates (as set by us) that appear on the “Order Summary” page at the time we receive your order.
You must provide the requested information for us to process your order. We reserve the right to request further information from you at any time to enable us to complete your order and / or to comply with regulatory requirements. We will use various procedures to authenticate each transaction. By placing an order, you confirm that the details contained in the order are correct in all respects. The system will display a confirmation page (the “Thank You” page) setting out the details of your order. This confirms receipt of your order.
A contract between you and us is only formed when we receive your payment and send you a confirmation email that your order has been accepted. Please print a copy of the confirmation page for your records. We may, at any time, decline to process your order or any part of your order for any reason including where insufficient or incorrect information has been provided, authentication has not been possible or an exchange rate has been quoted in error. 
 
Supply of Currency
We will supply physical currency to the value of your order on the date requested. 
 
Every effort is made to ensure that we have stock to cover these online orders but circumstance may make this impossible (eg wholesale supply issues, import/export limits).  
 
If it is clear that we cannot supply the amount in the timescale required we will contact you to discuss as soon as possible. If an alternative date or time is unsuitable we will fully refund any payments made. 
 
Currencies may be withdrawn from sale if stock levels are likely to be unavailable for a foreseeable period.  
 
Specific Denominations
You can request specific denominations by using the “Comments” section on the checkout page. We will endeavour to supply the denominations required but cannot guarantee them. The longer the lead time between order and collection date, the better chance of us supplying the desired denominations.   
 
If it is clear that we cannot supply a mix close to your request, we will contact you to discuss as soon as possible.  
 
Payment via In Store Payment 
If you have selected “In Store Payment” you must pay us when you collect your currency. This can be by Cash or Eftpos (to your daily card limit). If you select payment from a credit account we will pass on the bank fee of 1%, and your bank may charge you as a cash advance.    
 
Payment via BPAY®
Payments via BPAY® must be made from the account of the person obtaining the Service and not from a third party bank account. Please make your payment within 3 days or the rate may revert to the current day’s rate when you collect your currency.
 
Fees and Charges
The total sum payable by you for the issue of the Cash Passport Card you are purchasing will be shown on the “Order Summary” and “Thank You” page. 
 
Your Right to Cancel
An order can be cancelled at any time prior to the currency being collected, subject to the process set out below and your payment of the cancellation Administration Fee of $50 as well your payment to cover any foreign exchange loss suffered by The Currency Exchange (if applicable).
To cancel an order you must notify us by email (paul@thecurrencyexchange.com.au), you will also need to provide your details and your Transaction Reference Number. Please note that for the purposes of calculating whether there has been any foreign exchange loss suffered by The Currency Exchange we will make an approximation of our cost to repurchase that currency from our currency wholesaler on the relevant day which may result in a foreign exchange loss to The Currency Exchange which we will pass on to you. In addition you will be charged an Administration Fee of $50. 
We will email you with confirmation of the cancellation and the breakdown of the foreign exchange loss and the Administration Fee. The email will also provide instructions on how to pay the Administration Fee and potential foreign exchange loss via BPAY®. The Currency Exchange will then process your refund by reversing your original BPAY® payment to your Bank Account however it may take up to 14 days due to the banking system to credit your Bank Account. Please note that refunds can only be made after you have paid the Administration Fee and any Foreign Exchange Loss. Due to security reasons BPAY® refunds can only be made back to the originating account.

Personal Information and Security
We use secure server software to make our Internet transactions secure. Please click on this link Privacy Policy to find out how we may use and disclose your personal information.
You agree that all information provided by you is true and correct, that any material information will not be withheld and you will provide us with any additional information that may be required by us. The Currency Exchange may require additional information from you in order to comply with regulatory requirements.
 
Limiting Our Liability
We use reasonable care and skill in providing the Service. However, we shall not be liable to you for the following:
1.If we are unable to perform any of our obligations to you due to failure of any technical systems or for any other reasons beyond our reasonable control including, amongst other things, war, terrorism, government action, natural disaster, or industrial dispute; 
2.For any damage to your computer equipment as a result of using this website or the Service; or 
3.For any indirect or consequential losses, claims or damages suffered by you or incurred from your use 
of the website or the Service however caused. 
Our maximum liability to you in respect of each use of the Service for the purchase or reload of a Cash Passport Card shall be to refund the purchase price of that order. The disclaimers and limitations of liability in these terms shall not apply to any damages arising from death or personal injury caused by the negligence of The Currency Exchange or any of its employees or agents or for fraud. If any provisions of these terms including these disclaimers and limitations shall be unlawful or unenforceable then such provisions shall fall away and shall not affect the validity and enforceability of the remaining terms. This does not affect your statutory rights.
 
Alteration of Terms
We may at any time with immediate effect, in respect of future orders, change or withdraw the website, the Service and these terms without liability to you. If we revise these terms, we will post the revised version on our website at www.thecurrencyexchange.com.au by using the Service or placing orders after we have changed these terms, you will be accepting the changes.
 
Third Party Rights
When you place an order for the purchase or reload of a Cash Passport Card we are entering a contract with you personally. Nothing in these terms will confer any benefit, or any right to enforce these terms, on any third party.
 
Law and Jurisdiction
Our relationship shall be governed and interpreted in accordance with the laws in the State of New South Wales. Any dispute, which cannot be resolved between us, shall be resolved in the courts of New South Wales.
 
Refund of Credit Card Payments
If you cancel your order after payment is made by credit card your online order will be refunded less the 1.40% card surcharge fee. The Currency Exchange would not refund any charges made by your card provider (eg Cash Advance fees). Please note that refund processing times are out of our control and are subject to times imposed by your card issuer. We will process any refund as soon as possible but it may take a number of days for funds to be returned to your account. All refunds will only be made to the original card used in the transaction.   
 
The Currency Exchange is an agent of MasterCard for the purposes of selling its “Cash Passport” Product. MasterCard Prepaid Australia Pty Ltd (ABN 47 145 452 044, AFSL 386 837) arranges for the issue of the Multi-currency Cash Passport in conjunction with the issuer, Heritage Bank Ltd (ABN 32 087 652 024, AFSL 240 984). You should consider the Product Disclosure Statement (PDS) and Financial Services Guide (FSG) for the relevant Cash Passport before deciding to acquire the product. Any advice does not take into account your personal needs, financial circumstances or objectives and you should consider if it is appropriate for you.
